Data Backup/Restoration Notice:
OutletPC provides no guarantees (implied or otherwise) regarding data backup or restoration. Backups and restorations are by request only and due to varying levels of factors (both physical, non-physical, and logical) are not guaranteed. Customer is expected to retain all personal and up-to-date backups prior to submitting any hardware to OutletPC for diagnosis or repair. OutletPC will make a best-effort attempt at recovering and backing up individual files located in the following standard file locations: My Documents, My Pictures, and Desktop at the written request of the customer. This best-effort does not imply a guarantee nor does it imply any contract entered between OutletPC and the customer. In no case can non-file containing locations, software, serial numbers, licenses, or any other form of installed media be backed up. Backup only includes media files in the form of documents, pictures, and movies. Software can not be backed up nor can it be restored as software installation procedures require the use of the original media, licensing, and installation agreement. It is the customer's sole responsibility to backup all files, programs, installations, and other forms of data before submitting a computer to OutletPC to ensure that no data is lost in the repair process.
OutletPC retains no responsible for lost, missing, or damaged content of data on a customerís computer/device. Please be advised that during the normal course of a diagnostic or repair, if backup or restoration data and computer hardware is found to be in violation of federal or state law, OutletPC will report the incident to the proper law enforcement agency. If any data is backed up and restored it is done so in an as-is. Data can become corrupted or infected through diagnostic procedures. OutletPC does not inspect, monitor, view, or otherwise tamper with customer data in any way not directly related to the diagnostic or repair process. Customer is required to backup their data prior to submitting their computer to OutletPC to ensure that the quality and the integrity of the data backed up is maintained.
By submitting a servicing job to OutletPC you agree that any and all data, software, installations, files, or otherwise have been previously backed up and kept off-site as you deem appropriate. You understand and agree that once the repair process with OutletPC is complete it is your responsibility to restore this data, software, information or other files back to your computer in any way you deem appropriate. You acknowledge and agree that OutletPC shall not be responsible under any circumstance for any loss of hardware or software due to corruption, removal, damage, failure, or any other form of loss.
VIRUS & SPYWARE
OutletPC Computer Repair Virus & Spyware removal is guaranteed from re-infection for 3 business days from pickup date. Re-infection of viruses or malware after 3 business days from pickup date is not covered under OutletPC Computer Repairís repair warranty. OutletPC Computer Repair retains sole discretion as to the specific application of a given repair warranty. All other warranties are stated at time of purchase.
ILLEGAL FILES & LICENSING
OutletPC may, at its discretion, refuse to conduct servicing or repair processes for clients hardware that contains improper licensing, unauthorized, illegal, or objectionable file/folder contents or file/folder names, or that would involve repair procedures designed to circumvent the law / manufacturer procedures. Computer servicing and data backup procedures involve allowing access to your system resources and files for the purpose of evaluation. By entering into a service order with OutletPC you are granting full and unrestricted access to your hardware and software (including files, folders, and data) to our technical staff for repair and backup purposes. OutletPC reserves its right to report any and all illegal or suspicious materials discovered to Local, State, and Federal law enforcement agencies when deemed appropriate.
SERVICE LIMITATIONS; LIABILITY
(a) LIMITATIONS TO SERVICE: OUTLETPC RESERVES THE RIGHT TO REFRAIN FROM PROVIDING ANY OR ALL REQUESTED SERVICES AND INSTEAD REFUND YOUR PAYMENT, WHOLLY OR IN PART, ON THE BASIS THAT YOUR TECHNICAL NEEDS OR OTHER REQUIREMENTS ARE UNUSUAL OR EXTENSIVE AND BEYOND THE SCOPE OF THIS SERVICE AGREEMENT AS REASONABLY DETERMINED BY OUTLETPC.
(b) FORCE MAJEURE: If OutletPC's ability to render services is impaired by you or circumstances beyond the control of OutletPC, OutletPC may choose not to provide or to discontinue services.
(c) LIMITATION OF REMEDY: Under no circumstances shall OutletPC, and/or its third-party service provider be liable to you or any other person for any damages, including without limitation any indirect, incidental, special or consequential damages, expenses costs, profits, lost savings or earnings, lost or corrupted data, or other liability arising out of or related to the services provided by OutletPC and/or its third-party service provider or out of the installation, de-installation, use of, or inability to use your computer equipment, hardware, peripherals, or the network as a result of the services provided hereunder.
LIMITATION OF LIABILITY & RELEASE
By submitting a servicing request you agree to release and hold harmless OutletPC, and/or its third-party service provider from and against any loss, liability, or damage, including without limitation, any indirect, incidental, special or consequential damages, expense, costs, profits, lost savings or earnings or liability that you, the owner, or operator may suffer arising out of, or related to, the services provided by OutletPC. This includes but is not limited to data loss or lack of function in any component or element of your computer system and/or peripherals, as a result of OutletPC and/or its third-party service provider's agents, partners, and/or third-party service providers, regardless of the warranties, disclaimers, and waivers particular service and shall constitute liquidated damages and are a reasonable estimate of damages to you.
Any items dropped off that are not picked up from the OutletPC facility within 30 days including all devices, PCs, laptops, hardware, software, booklets, or otherwise will be considered abandoned property and disposed of accordingly. By submitting a servicing order to OutletPC customer is certifying that they have read, understand, and agree to all terms and conditions contained in this document and on the OutletPC Computer Repair website and on OutletPC.com.
